Introduction

Welcome to AgileFingers.com ("AgileFingers"), a web-based platform that offers typing practice, lessons, and games. Please read these Terms of Service ("Terms") carefully before using the AgileFingers website (the "Service"). By accessing or using AgileFingers, you agree to be bound by these Terms. Throughout these Terms, "AgileFingers," "Service," and "Terms" refer to AgileFingers.com and its Terms of Service. Thank you for choosing AgileFingers for your typing practice and learning experience.

You agree not to modify, copy, distribute, transmit, reproduce, publish, license, transfer, create derivative works from, sell, or resell any content or information obtained from or through AgileFingers.

Agreement to Terms

By using AgileFingers, you agree to these Terms. If you are a minor, a parent, guardian, or school must authorize your use where applicable law requires it. If you do not agree, stop using the Service.

Privacy Policy Reference

Our Privacy Policy explains how personal data is handled. Using the Service does not replace any separate consent required for a particular use of data.

Account Registration and Password Security

To use certain features of AgileFingers, you may be required to create an account and provide certain information about yourself, such as your email address. You are responsible for maintaining the confidentiality of your AgileFingers account and password. You are also responsible for all activities that occur under your account. You agree to notify AgileFingers immediately of any unauthorized use of your account.

Teachers can create student accounts with access codes, assign work, and view student results. If you manage student accounts, use this feature only when you have authority to do so. You or your school must provide students and, where required, their parents or guardians with the notices and obtain any permissions required for your use of their data. Student accounts do not require a student email address.

Use of AgileFingers

You may use AgileFingers only for lawful purposes and by these Terms, including the following:

• You agree not to use AgileFingers to upload, distribute, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
• You agree not to use AgileFingers to harm or attempt to harm minors
• You agree not to use AgileFingers to impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
• You agree not to use AgileFingers to interfere with or disrupt AgileFingers or any servers or networks connected to AgileFingers or disobey any requirements, procedures, policies, or regulations of networks connected to AgileFingers;
• You agree not to use AgileFingers to upload, distribute, or transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation;
• You agree not to use AgileFingers to upload or distribute any software viruses or other harmful code;
• You agree not to use AgileFingers to harvest or collect information about others, including email addresses.

Your responsibilities

You are responsible for the content you submit and for using the Service lawfully. Any liability arising from a breach of these Terms is determined under applicable law.

6. Modifications to Terms of Service

AgileFingers may modify these Terms from time to time. The most current version of the Terms will always be available on this page. You agree to be bound by any modifications to the Terms by continuing to use AgileFingers after such modifications have been made.

Data Retention Policy

The Privacy Policy describes the data we keep and how to request its deletion.

Removing a student blocks access and retains the account and related records for administrator recovery or permanent removal, whether or not the student has saved scores. Removing a class blocks it and its students while retaining the class, assignments, and results for administrator recovery or permanent removal.

Deleting your own account also blocks the students you manage. Restoring your account does not automatically restore them. Administrators can permanently remove retained records at any time and have a manual bulk control for students and classes removed at least 30 days earlier. The 30 day threshold is eligibility for that control, not an automatic deletion date. Large deletions may need repeated runs.

Termination

You can remove your personal account from your profile. A teacher can remove managed student accounts and classes. Stopping use alone does not delete an account or its data. We may suspend or terminate access for a breach of these Terms or where needed to protect the Service, subject to applicable law. Removal immediately stops access; the retention and recovery rules above then apply. Contact us through the contact form to request erasure of retained personal data.

Disclaimer of Warranties

We work to keep AgileFingers available and functioning, but cannot guarantee uninterrupted or error-free service. Nothing in these Terms limits rights that cannot be excluded under applicable consumer or data protection law.

Limitation of Liability

Any limitation of liability applies only to the extent permitted by applicable law. Mandatory consumer rights and liability that cannot legally be excluded remain unaffected.

Links To Other Web Sites

Our Service may contain links to third-party websites or services that are not owned or controlled by AgileFingers. AgileFingers has no control over and assumes no responsibility for any third-party websites or services' content, privacy policies, or practices. You further acknowledge and agree that AgileFingers shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services you visit.
